Terms and Conditions of Use
Last Updated: October 26, 2026 | Governing Jurisdiction: Ontario, Canada
LEGAL NOTICE REGARDING CIVIC STATUS: CityofWelland.com is a privately owned, independent, grassroots digital town square operated and funded by local citizens. We are entirely separate from, and have no official affiliation, authorization, association, or endorsement by the municipal government of the City of Welland (welland.ca), its regional city council, or any public administrative subsidiaries. This platform serves as a private forum to discuss local life, traditional values, faith, and family structures.
1. Acceptance of the Agreement
By accessing, browsing, registering on the whitelist, or creating an active user account on CityofWelland.com (the "Platform"), you agree to be bound by these Terms and Conditions, all applicable local laws, and federal Canadian regulations. If you do not agree with any part of these terms, you are legally prohibited from using or accessing this Platform.
2. Strict Age Restrictions & User Eligibility
This Platform is designed as a secure, adult-centric network dedicated to real-world community action. You must be at least twenty-one (21) years of age to register an account, join groups, or post content on CityofWelland.com. By completing your whitelist enrollment or login configuration, you legally represent and warrant that you meet this age requirement. Platform administrators reserve the unilateral right to request proof of age at any time. Accounts found to be held by individuals under the age of 21 will be instantly and permanently deleted, alongside all correlated system data, without warning.
3. Platform Membership Tiers & Access Rights
Access features are assigned across three distinct community user tiers. By using the site, you agree to stay within the boundaries dictated by your approved account tier:
- Standard Members (The Ground Force): Granted permanent, free access to local and Canadian automated news feeds, basic commenting modules, discussion threads, and the ability to publish public Member Articles.
- Expert Leaders & Group Hosts (The Community Engines): Granted highly vetted, premium forum moderation privileges and dedicated group hosting assets to share industry or organization-specific insights.
- Premium Members (The Action Architects): Granted access to advanced architectural tools, interactive course suites, action assignments, custom group creation mechanisms, and private messaging utility panels.
4. User Conduct, Prohibitions, & Reporting Systems
To foster an alternative, distraction-free environment that prioritizes family structures and street safety, all members are bound by our Community Code. You agree not to publish, link, or upload content that contains:
- Harassment: Bullying, abusive tactics, personal insults, or defamatory statements targeting neighbors or local business operators.
- Inappropriate Content: Explicitly mature, sensitive, adult, or sexually graphic text and media arrays.
- Misinformation: False local news alerts, malicious neighborhood rumors, or fraudulent civic reporting.
- Suspicious Activity: Automated commercial link-farming, tracking scripts, malicious software, or unapproved marketing malware.
Member Moderation Tools: The Platform utilizes a live peer-governed safety system. Users maintain the absolute right to utilize the Report Tool to flag problematic activity under specific violation metrics (Harassment, Inappropriate, Misinformation, Offensive, or Suspicious). Members also retain the right to unilaterally execute the Block Member mechanism, which instantly severs mutual private communications, profile views, tagging, and group invitation tracking across the network database.
5. Intellectual Property Rights & Commercial Local Advertising
Standard text updates, member comments, and general feed items remain the property of the posting individual. However, premium educational assets, proprietary business courses, and custom layouts generated by **Expert Leaders or Premium Members** remain locked under explicit intellectual property rights of those registered entities.
Advertising Space: Local advertising features operate via direct, independent partnership configurations rather than global automated ad networks. Platform administration retains full design curation and formatting rights over directory cards and activity feed banner placements to keep our digital environment noise-free and clear of third-party tracking beacons.
6. Limitation of Liability & Technical Warranty
CityofWelland.com is provided entirely on an "as-is" and "as-available" blueprint baseline. We provide zero explicit or implicit warranties regarding continuous technical platform uptime, background real-time communication sync speeds, or the absolute factual correctness of neighbor opinion articles, contractor recommendations, or neighborhood statements. Under no legal circumstances shall the Platform administration, founders, or local server moderators be held liable for any damages, losses, or communication disruptions arising out of your reliance on user-submitted data.
7. Indemnification
You agree to indemnify, defend, and hold harmless CityofWelland.com, its administrative staff, organizers, and localized team from and against any and all claims, liabilities, legal expenses, damages, costs, or court adjustments resulting from your direct violation of these terms, your published content arrays, or your misuse of the community interactive frameworks.
8. Severability and Right to Amend
If any clause contained within this Terms and Conditions layout is deemed unlawful, completely void, or unenforceable by an Ontario court of law, that specific provision shall be viewed as severable from the remaining body of terms and will not impact the validity, legality, or absolute binding power of the remaining provisions. Platform administrators reserve the unilateral right to modify, adapt, or update these terms at any time to preserve database integrity and public neighborhood safety parameters.
9. Governing Law & Dispute Resolution
Any legal actions, claims, or procedural disagreements arising out of or directly relating to CityofWelland.com shall be governed entirely by the laws of the **Province of Ontario and the federal laws of Canada**, without regard to global conflict of law principles. You explicitly submit to the exclusive jurisdiction of the regional courts located within Ontario to resolve any operational or platform disputes.
